Last updated: [02/01/2025]
These Terms and Conditions (“Terms”) govern your access to and use of the website chicagopizza.in and any related mobile application, products, and services (collectively, the “Services”) offered by Chicago Pizza (“Chicago Pizza,” “we,” “us,” or “our”). By accessing the site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1) Acceptance of Terms
- By using the Services, you confirm you are legally capable of entering into a binding agreement and that you will comply with all applicable laws and regulations in India.
- We may update these Terms at any time by posting a revised version on the site. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
2) Eligibility
- You must be at least 18 years of age to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.
- We reserve the right to suspend or terminate access if we reasonably believe eligibility requirements are not met or information provided is inaccurate.
3) Account Registration and Security
- You may need to create an account to place orders. You agree to provide accurate, current, and complete information, and to update it as needed.
- You are responsible for safeguarding your login credentials and all activities under your account. Notify us promptly of any unauthorized use.
- We may reject, suspend, or terminate any account at our discretion.
4) Menu, Pricing, and Taxes
- All menu items, descriptions, prices, offers, and availability are subject to change without prior notice and may vary by location or time.
- Prices are displayed in Indian Rupees (INR). Applicable taxes (including GST) and delivery or packaging charges will be shown at checkout.
- If there is an error in pricing or product information, we may cancel the order (even after confirmation) and issue a refund or request the additional amount, as appropriate.
5) Ordering and Payment
- Placing an order constitutes an offer to purchase. We accept your offer when we send a confirmation via the site, email, SMS, or begin preparing your order.
- Payment options may include UPI, credit/debit cards, net banking, and wallets via secure, RBI-compliant payment gateways. Cash on delivery may be available at select locations and times only, and may be subject to additional terms.
- You authorize us and our payment processors to charge your selected payment method for the total amount shown at checkout, including applicable taxes and fees.
- If a payment is declined or reversed, we may cancel the order without liability.
6) Delivery, Pickup, and Fulfilment
- Delivery is available only within designated service areas shown at checkout. We may decline orders outside our service zones.
- Any delivery or pickup times provided are estimates only. Delays may occur due to traffic, weather, order volume, operational issues, or third-party courier constraints. Such delays do not entitle you to compensation or refunds unless specifically stated.
- Title and risk of loss pass to you upon delivery to your address or collection at the store. Please inspect your order at handover and report any issues promptly (ideally within 10–15 minutes).
- Deliveries may be fulfilled by our in-house teams or independent third-party riders. Such third parties are not our employees or agents.
7) Cancellations, Returns, and Refunds
- Customer-initiated cancellations are allowed only before preparation begins. We typically start preparing orders within a few minutes of confirmation; once preparation starts, cancellations may not be accepted.
- We may cancel orders for reasons including unavailability, technical errors, suspected fraud, payment issues, or events beyond our control. If we cancel, you will receive a refund of any amount charged.
- Perishable food items are non-returnable. If there is a verified issue (e.g., wrong item, significant shortage, or product not in acceptable condition on delivery), please contact us immediately with supporting evidence (photos, order ID). Resolutions may include a replacement, credit, or partial refund at our discretion.
- Refunds, where applicable, will be processed to the original payment method within a reasonable period (usually 7–14 business days), subject to your bank/payment provider timelines.
- We do not offer refunds for change of mind, taste preferences, allergies not disclosed before ordering, or issues reported after substantial consumption or unreasonable delay.
8) Promotions, Coupons, and Gift Cards
- Promotional codes, discounts, or offers are subject to specific terms communicated at the time of use and may be limited by time, location, or account eligibility.
- We may void promotions for misuse, fraud, or technical errors, and may restrict usage to one per user/account/device/address at our discretion.
- Gift cards or credits (if offered) are non-transferable, non-refundable, and not redeemable for cash unless required by law.
9) User Conduct and Acceptable Use
You agree not to:
- Engage in any activity that disrupts or harms the site or its infrastructure (e.g., hacking, introducing malware, scraping without permission).

- When you submit reviews, comments, images, or other content, you represent that your submissions are truthful, non-confidential, lawful, and do not infringe any third-party rights.

17) Force Majeure
- We will not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, epidemics, war, labor disputes, government orders, or failures of networks or third-party services.
18) Suspension and Termination
- We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.
- You may stop using the Services at any time. Sections that by their nature should survive termination (e.g., IP rights, disclaimers, limitation of liability) will continue to apply.
